NSP – May 24, 2017 – Bonus Wednesday Edition: Episode 21 – Cross-examination Using the Socratic Method

Posted on May 30th, 2017 by Calvin

Show Notes:

  • Debunking more trolls by continuing to refer to the documented evidence.
  • Groups of men and women who force people to pay them are nothing more than organized criminals.
  • Ginger’s recent success story, using the motion to dismiss, where the prosecution withdrew their complaint stating “state moves to dismiss for insufficient evidence.” (documentation pending)
  • “What can be asserted without evidence can be dismissed without evidence.” – Hitchen’s razor
  • Gary Murphy’s order to his subordinates to not take Marc’s calls because they are embarrassing to the agency. (FIOA request documentation pending)
  • Lawyers don’t challenge ALL of the prosecutor’s assertions for fear of pissing-off the judge.
  • Effective damage-control demands you do not give the prosecution a free-pass on their burden to prove their assertions; primarily their assertion of jurisdiction based upon your physical location.
  • Learning how to effectively cross-examine a witness by asking the proper questions for the appropriate type of hearing.
  • Competency & credibility, and all prior statements, are a part of a relevant and effective cross-examination.
  • Countering the common judicial lie that jurisdiction is a trial issue only.
  • Denial of effective cross-examination is one of the most serious violations of misconduct a judge can commit.
  • Recognizing when you are being railroaded through an outcome-based proceeding to just secure a conviction despite the prosecution’s lack of evidence to substantiate their case.
  • Contradictory, inconsistent, or non-responsive statements are what you want to hone-in on when you are engaged in cross-examination.
  • Doing whatever you can to avoid litigating in court.
