Congrats to Tenny for standing up to the IRS and getting an assessment dropped. And thanks for the documentary proof.
I have to say this is not an example of my typical help with the IRS, such as this one. Here the IRS made arbitrarily denials of exemptions and wanted thousands from Tenny. I figured this would be easier than our usual attacks, and would make a jurisdictional claim if needed.
I wrote the response to the IRS and pointed out that despite any evidence the constitution and code applied, a return was filed under threat, duress and coercion. The IRS had arbitrarily denied an exemption and that if not corrected, we wanted an agent assigned with direct contact information so the matter could be resolved.
Tenny got several 45 day letters where the IRS asks for additional time to research the matter. Eventually Tenny received the following letter where the IRS dropped it’s assessment.
Anyone who has dealt with the IRS knows how cruel and vicious they are, they don’t usually back down when wrong. That is why I still post this even though it was not a jurisdictional challenge, it is still significant for two reasons. One, it’s the IRS, a terrorist organization and two, Tenny did it without having to hire an overpriced attorney or CPA.
