Ginger Gets Ticket Dismissed in Texas – Insufficient Evidence

Congrats to Ginger in Texas for successfully defending against bogus charges, and thanks for providing the proof.  The proof is from the Bexar County Court 5 website.

Ginger’s defense was the same as what we’ve done for a long time here, there was no evidence to support the prosecution’s claims.  These claims are that the constitution and laws apply to Ginger just because he’s physically in Texas, that Ginger violated those laws.  A discovery/Brady request was filed with the motion to dismiss.

As you can see, the charges were dismissed without trial for insufficient evidence.  That was Ginger’s defense.

Yes, while there are other plausible explanations, the strongest explanation is the ticket was dismissed based on Ginger’s defense.  The evidence we have, without assumptions, points to Ginger’s defense as the reason for the dismissal.  All other explanations, while plausible, are very weak as they require assumptions.

There just isn’t evidence proving there magical rules (“constitutions” and “laws”) apply to us.  There is no evidence proving there are reciprocal obligations of allegiance and protection, therefore, there are no citizens and states.

If one stops the reification process, and looks at the evidence, the truth is easy to see.  There is no “government”, just men and women forcing us to pay them.  They are criminals, that is why they cannot prove their “laws” apply to us.

If you disagree, and think you can prove there are states/governments, then please provide your evidence of reciprocal obligations of allegiance and protection.

    The arraignment part is what trips me up. How do you handle arraignment without NOT GUILTY/GUILTY? I tried handing the unsigned paperwork before but it was such a hassel.

    If you use the unsigned plea of guilty and they ignore you and plead not guilty over your objection, then we file a motion to change the judge. Check out this article for details about the errors the judge is committing

    I strongly like and appreciate that you call the bureaucrats and other totalitarians criminals. That’s exactly what they are. I’m in court this month, trying to defend my life and liberty against their attacks…

    I agree, Jake, but I’m also amazed at the apparent majority of the population who demand this criminal action be inflicted upon their neighbors. Are not these people equally culpable criminals?

    I’m reminded of the photographs of the proud, smiling crowds surrounding a black man hanging from a tree-limb, being burned with torches, and bits cut off of him for souvenirs.

    Entering of plea of guilty or not guilty is a waiver of defect in the complaint.

    Some defects can’t be waived such as the one that Marc accentuates.

    If prior to plea you object to some defect that defect must be cured prior to plea being entered.

    Indio, So to get clear on your meaning, are you suggesting that by objecting that evidence of jurisdiction has not been shown, any pleas entered “on your behalf” by “the court” are automatically null and void, or automatically cause for… something?

    “Dismissed-Insufficient Evidence” could me lots of things. Could mean that the prosecution couldn’t prove jurisdiction…could mean that the cop hat issued the ticket didn’t show up to testify.
