Motion to Dismiss Granted Again – Jeffrey M. Shock Cannot Prove Jurisdiction – [UPDATE: Audio interview with Tait]

A big congrats to Tait for not only standing up to the criminals called “government” but for not backing down and getting the ticket dismissed. And thanks for permitting me to post the evidence without redacting anything.

Things did not go well at the beginning, I suggested Tait break the motion to dismiss into several, just one or two issues per motion. This way the judge may not so easily just deny without explanation.

The judge actually ordered the prosecutor to respond to the motions. Yeah, I know, that’s not what usually happens, but when it does the prosecutors usually withdraw their complaints. The order is below.


Jeffrey M. Shock, the lawyer pretending he has a client, the fiction known as the “State of Wisconsin,” a dba at best, did comply with the judge’s order.  True to form though, Jeffrey could not provide any evidence or directly address any of the issues raised.  The most important issue being he had no evidence to support his claim the laws applied to Tait because he was physically in Wisconsin.  You can’t provide what doesn’t exist.

Jeffrey lies in his response, typical for prosecutors.  Jeffrey claims:

The pleadings submitted by the defendant have no basis in law or fact and, therefore, should be denied.

This is obviously false, even on the law, plenty of legal citations were given.  Because Jeffrey could not overcome the issues, he lies claiming they are not even there.  Apparently lawyers are taught that if someone raises issues you disagree with, the proper thing to do it deny they are there.  You can also just call it “gibberish” and that magically defeats the claim.  David filed a false statement with the court, that’s not only an ethical violation, but probably a crime.  It did go through the mail.


Just giving conclusions, without any evidence, is what prosecutors do, you’re a taxpayer, you’re a resident, you owe taxes, the laws apply to you etc.  Here, a judge once again held the prosecutor to his burden of proof, and Jeffrey lied, because why would a prosecutor be honest?  There is no evidence proving rules written by people called “government” apply to anyone.

The judge, David J. Wambach, though part of a criminal organization, did the right thing and granted the motion to dismiss.  And he was explicit about it.

[Jeffrey’s] reply is conclusory and contains no analysis; no citation to authority; nor any application of the facts to the law-or an explanation why such application is unnecessary by the Court.

This has to be the clearest order in our favor that I can remember.  There is no doubt David granted the motion and dismissed the ticket.


The above is not redacted, anyone can go to the court’s website and check the docket and confirm.  The motion to dismiss is based primarily on the prosecutor’s lack of evidence proving the laws apply to Tait just because he’s physically in Wisconsin.  Jeffrey could not provide any evidence to support this because no such evidence exists.

Some critics claim no evidence is needed, that is because they are dishonest or they believe in magic.  Do you believe people can create rules that apply to everyone just because they say so?  And I’m the fraud because I point out their claim requires evidence?  If they don’t have to prove their claim is true, then that is solid evidence of a rigged game, certainly not a system of justice.

redditor-trafficOther critics, in a pathetic attempt to marginalize this additional evidence, will brush it off saying, “It’s just traffic.”  Don’t buy it; traffic tickets rest on the same bogus claim as felony possession e.g., if you’re physically in Wisconsin, then the laws apply.

And I’ll say it again, if it’s so easy to prove the laws apply because you’re physically in Wisconsin, then Jeffrey (and the other hundreds of attorneys/politicians) would just have provided his proof.  He didn’t because there is no evidence their special rules (“laws”) apply to us.  Instead he lied about the issues raised.  No evidence and he lied; looks like a criminal to me.

    Well done. Great to see the judge not bail out the prosecutor but rather hold his feet to the fire. And when he couldn’t produce a valid argument he wasn’t given a free and inexplicable pass. Case dismissed.

    @ motljoe, the cartoon is poking fun at trolls at reddit. A used to reference the typical critics who try to marginalize my work by dismissing it as “just traffic.” Some people just can’t accept they are wrong, so they reject the evidence.

    I hope he files a risk management claim. You can find the rules in the governmental tort claims act, or whatever your state calls it.

    It seems the prosecutor was relying upon the ” business as usual ” buddy system to carry him through this case as it usualy does .Kudos to an honest judge !
